Bruce Telecom ACCEPTABLE USE POLICY

Bruce Municipal Telephone System (Bruce Telecom) is an Internet Service Provider, and use of Bruce Telecom's facilities by any Customer must be consistent with Bruce Telecom's Acceptable Use Policy. The ultimate responsibility for network traffic that does not conform to this policy lies with the individual end-user who originates that traffic and all consequences lie with this individual. Bruce Telecom does not assume any responsibility for information transmitted by anyone other than an owner, agent or employee of this company.

The Customer agrees to abide by the local, provincial and Canadian federal laws, and the guidelines set forth.

1. General Conduct

Individual dial-up accounts are intended for use by an individual. Shared accounts and/or multiple logins are prohibited.

Bruce Telecom services may be used for lawful purposes only. Transmission, distribution, or storage of any information, data or material that is violation of International regulations,. Canadian Federal laws, or provincial law is strictly prohibited. This includes, but is not limited to material protected by copyright, trademark, trade secret or any other statue. Bruce Telecom reserves the right to discard any such illegal material which may be stored on its servers.

The Customer is prohibited from transmitting on or through any of Bruce Telecom services any material that is, in Bruce Telecom sole discretion, unlawful, obscene, threatening, abusive, hateful, libelous, or that would encourage conduct that constitutes a criminal offense, or would otherwise violate any provincial, federal or international law.

The resale of Bruce Telecom products and services is not permitted, unless permission is specifically granted and documented in a written agreement.

Bruce Telecom reserves the right to cancel or put any Customer service on hold for non-payment or violation of its Acceptable Use Policy.

2. Network Security

Users who violate systems or network security may incur criminal prosecution under Canadian federal laws or international laws. Bruce Telecom will fully cooperate with investigations with respect to security violations within this site or other sites, including full cooperation with law enforcement agencies in the investigation of suspected criminal activities.

Customers are responsible for maintaining the secrecy of their network access codes (usernames and passwords). Customers are discouraged from sharing such information with others.

Password security is the responsibility of the individual user. Good passwords should be a minimum of six characters long, contain a least one number or symbol and not be based on any dictionary word or common name.

Customers may not attempt to circumvent user authentication, or security of any host, network, or account. This includes, but is not limited to accessing data not intended for the Customer, logging into an account or server which the Customer is not expressly authorized to access, or probing the security of other networks such as running scanning software such as SATAN or ISS.

Customers may not attempt to interfere with the service to any user, host or network (i.e. denial of service attacks). This includes, but is not limited to, ping flooding of networks, or deliberate attempts to overload or impede a service or attempts to crash a host.

Customers may not attempt to impersonate others or use IRC or WebChat anonymously by disguising their hostname or username.

Customers are prohibited from running any software program or application that will interfere with or deny service to other users on any server or host.

Bruce Telecom may restrict service or terminate any subscriber who employs applications which unreasonably jeopardizes the technical security and performance of the system, operates applications intended to circumvent idle connection avoidance programs or precipitates actions or threats of actions by other domains due to intolerable activities on other host sites. Bruce Telecom reserves the right to decide if any of the above violations apply to a given personal account. Repeated abuse will result in an e-mail notification to a user. Subsequent abuses will result in forced disconnection followed by denial of re-connection. Bruce Telecom reserves the right to suspend or terminate a subscription, without specifying cause, immediately upon notice to any subscriber. E-mail

Electronic mail passes through multiple mail servers on the Internet. Bruce Telecom does not guarantee privacy for the Customer's e-mail. Customers requiring privacy are therefore notified to use encryption technology to render their messages unreadable by potential eavesdroppers.

With respect to Bruce Telecom e-mail servers, Bruce Telecom places a high value on user privacy and will only examine a user's e-mail when absolutely required, for example during troubleshooting procedures or in cooperation with law enforcement authorities upon presentation of a search warrant of information.

Harassment, whether through language, frequency, or size of messages is prohibited.

Customers are explicity prohibited from sending unsolicited bulk e-mail messages ("junk mail" or "spam"). Such material can only be sent to those who have explicitly requested it. If a recipient asks to stop receiving e-mail, the Customer must not send that person any further e-mail.

Customers may not forward or otherwise propagate chain letters, whether or not the recipient wishes to receive such e-mail.

Malicious e-mail, including but not limited to "e-mail bombing" (flooding a user or site with numerous large messages) is prohibited.

Forging e-mail headers information is prohibited.

Posting to USEnet Newsgroups must comply with the written charters or FAQs for those newsgroups. Advertisements should only be posted to newsgroups whose charter/FAQs explicitly permit such traffic.

1. Posting a single article or substantially similar articles to an excessive number of newsgroups or continued posting of articles which are off-topic (e.g., off-topic according to the newsgroup charter or the article provokes complaints from the regular readers of the newsgroup for being off-topic).

2. Sending unsolicited mass e-mail which provoke complaints from the recipients.

3. Mail bombing: Sending large volumes of unsolicited e-mail to individuals or to individual business accounts with the intent or result of limiting usability of the account or system in question.

4. Engaging in either (1) or (2) from a provider other then Bruce Telecom and using an account on Bruce Telecom as a mail drop for responses, or to draw attention to a website housed within Bruce Telecom’s networks.

5. Continued harassment of other individuals on the Internet after being asked to stop by those individuals and/or by Bruce Telecom.

6. Impersonating other users or otherwise falsifying one’s user name in e-mail, Usenet postings, on Internet Relay Chat(IRC), or any other Internet service. (This does not preclude the use of nicknames in IRC).

7. Network unfriendly activity: Attempts to interfere with regular workings of Bruce Telecom’s systems or network connections or related computers, systems, servers or networks or which adversely affect the ability of other people or systems to use Bruce Telecom services or the Internet, including, but not limited to:

          I. Any unauthorized attempts by a user to gain root access or access to any account not belonging to that user on this or any other Bruce Telecom system;

         II. Any use of this or any other Bruce Telecom system as a staging ground to disable other systems.

8. Privacy violations: Attempts, whether successful or not, to gain access to any other system or users’ private data without express consent of the user.

9. Use of IRC bots or clonebots on Bruce Telecom, whether on IRC servers controlled by Bruce Telecom or by other parties.

10. Any use of unauthorized robots or spiders from, through or against Bruce Telecom computers, systems, servers or networks.
Web Services

Bruce Telecom provides web services to its Customers. Web pages reside on Bruce Telecom owned computer equipment giving Bruce Telecom some ethical responsibility for the content of such pages. Bruce Telecom reserves the right (and the Customers agrees under this AUP), under its sole discretion, to remove any web content that it deems inappropriate. This includes, but not limited to, downloadable virus code or obscenity.

Terms & Conditions

For the purpose of this agreement:

"Client" means a Person who has:

1. Requested or been furnished with the Services or other communication services from or by Bruce Telecom or their employees or agents.

2. Obtained installation, of any other form of service or equipment from Bruce Telecom or their employees, agents or dealers.

By purchasing Bruce Telecom Access Service/Accessing Bruce Telecom Home Page you agree to be bound by the conditions listed below:

1. Conditions: You may not:

* Post, transmit or otherwise distribute information constituting or encouraging conduct that would constitute a criminal offense or give rise to civil liability, or otherwise use the Bruce Telecom Site in a manner which is contrary to law or would serve to restrict or inhibit any other user from using or enjoying the Bruce Telecom Site or the Internet;

* Post or transmit any information or software which contains a virus, cancelbot, trojan horse, worm or other harmful or disruptive component;

* Upload, post, publish, transmit, reproduce, or distribute in any way, information, software or other material obtained through the Bruce Telecom Site which is protected by copyright, or other intellectual property right, or derivative works with respect thereto, without obtaining permission of the copyright owner or rightholder.

USE BY CLIENT OF INTERNET

The client shall be responsible for their access to the internet and ensure that no unauthorized use is made through the connection provided by Bruce Telecom. If the customer chooses to use long distance number to access the Internet by changing dialup parameters, customer is responsible of any long distance charge that are incurred.

COMPLIANCE WITH LAWS

Where the Client accesses other networks through the Internet connection provided by Bruce Telecom hereunder, the Client agrees to comply with the rules of such networks. The Client also agrees to use the Internet only for lawful purposes. The transmission of any material in violation of any provincial or federal legislation is strictly prohibited.

CRTC

Not withstanding anything to the contrary herein contained, Bruce Telecom may also terminate provision of service to the Client and the agreement without notice to the Client if the performance of this agreement would result in non-compliance with any applicable statue or regulations or the regulations or requirements of the CRTC or other regulatory authority having jurisdiction.

ELECTRONIC MONITORING

Bruce Telecom has the right to monitor the Bruce Telecom Site electronically from time to time and to disclose any information as necessary to satisfy any law, regulation or other governmental request, to operate the Bruce Telecom Site properly, or to protect itself or its subscribers. Bruce Telecom will not intentionally monitor or disclose any private electronic-mail message unless required by law. Bruce Telecom reserves the right to refuse to post or to remove any information or materials, in whole or in part, that, in its sole discretion, are unacceptable, undesirable, or in violation of this agreement.

PRIVACY

Bruce Telecom cannot insure or guarantee privacy for Bruce Telecom users. It is therefore recommended that this service not be used for the transmission of confidential information. Any transmission of confidential information shall be at the sole risk of the user, and Bruce Telecom its affiliate and related companies shall be relieved of all liability in connection therewith.

FINANCIAL TRANSACTIONS OVER THE INTERNET

When making purchases or other transactions through the Bruce Telecom Site or the Internet, you may be asked by the merchant or information or service provider to supply certain information, including credit card or other payment mechanisms. You agree that all information you provide any merchant or information or service provider through the Bruce Telecom Site will be accurate and complete. You agree to pay all charges incurred by you or other users of your account and credit card or other payment mechanisms at the prices in effect when such charges are incurred. You also will be responsible for paying all applicable taxes, if any, relating to purchases on the Bruce Telecom Site. Bruce Telecom is in no way responsible for any charges you or any user of your account incurs when making purchases or other Financial transactions in this manner.

LIMITATION OF LIABILITY

Bruce Telecom takes no responsibility for the accuracy or validity of any claims or statements contained in the documents and related graphics on the Bruce Telecom Site. Further, Bruce Telecom makes no representations about the suitability of any of the information contained in the documents and related graphics on the Bruce Telecom Site for any purpose. All such documents and related graphics are provided without warranty of any kind. In no event shall Bruce Telecom be liable for any damages whatsoever, including special, indirect or consequential damages, arising out of or in connection with the use or performance of information available from the service, including but not limited to damages which might arise as a result of any viruses or other disruptive or destructive programs which you might receive from using the service.

RECOURSE

If you are dissatisfied with the Bruce Telecom Site or with any terms, conditions, rules, policies, guidelines, or practices of Bruce Telecom in operating the Bruce Telecom Site, your sole and exclusive remedy is to discontinue using the Bruce Telecom Site.

INDEMNITY

You agree to defend, indemnify and hold Bruce Telecom harmless from any and all liabilities, costs and expenses, including reasonable attorneys' fees, related to any violation of this Agreement by you or users of your account, or in connection with the use of the Bruce Telecom Site or the Internet or the placement or transmission of any message, information, software or other materials on the Bruce Telecom Site or on the Internet by you or users of your account.

COPYRIGHTS/TRADEMARKS

Bruce Telecom (tm) and logo identifying Bruce Telecom products and services referenced herein are trademarks of Bruce Telecom. All other product and/or brand or company names mentioned herein are the trademarks of their respective owners.

"Copyright may exist in works published on the Internet. You agree to respect the rights of a copyright holder and will obtain such consents where applicable for the use of any material published on the Internet".

TERRITORY

The Bruce Telecom Site originates in Grey Bruce, Counties, Canada.

TERM AND TERMINATION

The Term of the agreement is when either party terminates the same, upon thirty (30) day written or electronic notice. Bruce Telecom reserves the right to immediately suspend or terminate the Customer's service due to any breach of this agreement.

You agree to abide by the terms of the "Bruce Telecom acceptable use policy" regarding internet usage as posted on the Bruce Telecom site as amended from time to time.

FORCE MAJEURE

Performance by Bruce Telecom hereunder may be delayed by any cause beyond its reasonable control.

MISCELLANEOUS

Bruce Telecom's failure to insist upon or enforce strict performance of any provision of this Agreement shall not be construed as a waiver of any provisions or right. If any of the provisions contained in this Agreement be determined to be void, invalid or otherwise unenforceable by a court of competent jurisdiction, such determination shall not affect the remaining provisions contained herein. This Agreement shall be governed by and construed in accordance with the laws of the province of Ontario and the federal laws of Canada applicable therein. The parties have required that this agreement and all documents relating thereto be drawn up on English.

Newsgroups Terms of Service

The content of all discussion groups (a.k.a. newsgroups), including without limitation, the descriptions of discussion groups and the content within a specific article posted in a group, is provided by and is the full and sole responsibility of the creator of the discussion group, or the person posting the article, respectively. Newsfeeds.com has NO responsibility for such content and is merely a conduit of articles traveling across Usenet. Usenet in general, is a public discussion and posting forum, similar to the world wide web, which is also available to the public. Newsfeeds.com does not control, condone, or censor Usenet and its content in any way.

All articles posted on our servers are pushed to the servers via our upstream providers, some of which are large international corporations. Newsfeeds.com receives well over 2 million articles per day, and it is impossible for us or any other corporation running a Usenet server to moderate newsgroups. At this point, there are no state or federal laws that require any ISP or Usenet provider to moderate Usenet newsgroups.

By its very nature, Usenet groups may carry very offensive, harmful, inaccurate or otherwise inappropriate material, or in some cases, postings that have been mislabeled, or are deceptive in another way. We expect that you will use caution and common sense and exercise proper judgment when using Usenet, as well as use the service at your own risk.

Again, we must emphasize that it is impossible for us or any other Usenet service provider to police hundreds of thousands of articles that pass through our servers on a daily basis. Any article that passes through our servers and its content is the SOLE RESPONSIBILITY of the person who posted the article or created the newsgroup.

What we mean when we say “publish or distribute” is that we DO NOT extract pictures or programs from Usenet for redistribution by various means, such as putting them on CD-ROM or making slide shows, or putting them in zip files and making them available for download.

* Newsfeeds.com does not condone, nor support users posting copyrighted or illegal content to Usenet. If you discover an article that contains any copyrighted or illegal content, please email us at abuse@newsfeeds.com or submit a support request at http://www.newsfeeds.com/support.htm. We will then remove the offending article IMMEDIATELY, and forward any and all relevant information to the appropriate federal law enforcement authorities.

Please not that the name of a newsgroup is not illegal in nature and does not necessarily imply that inappropriate or illegal activity occurs in it. However, we do encourage our customers to exercise caution and discretion when viewing and posting to all Usenet newsgroups. All content, without limitation, is provided by and is the sole responsibility of the person posting the content. We expect all customers to abide by Usenet etiquette, copyright laws, and civil and criminal laws.

CONDITIONS OF USE

They will inform you if your posting access has been revoked and the reason. If it has, and you feel this was done in error, please contact us and explain the situation. Our abuse department will then investigate and inform you of their decision in an email. The decision of the abuse department is final and NO refunds will be granted due to inability to post after your posting access has been blocked. You will still have the ability to read articles, however.

FORBIDDEN ACTIVITIES

Newsfeeds.com has a zero-tolerance policy for the following activities, and performing any of them will cause permanent suspension of your posting ability. These activities include, but are not limited to:

- Spamming: Advertising that is not welcome in the group where it was posted. If you do spam, you may be billed for the cleanup costs (at the discretion of the Newsfeeds.com management) at the rate of $200.00 USD per hour, plus any collections and/or attorney's fees incurred in the collection of this fee.

- Flooding: Attempting to take over a newsgroup by flooding it with your posts.

- Trolling: Harassing or annoying other newsgroup users repeatedly.

- Copyright Infringement: Posting anything that is not in the public domain and that you do not own the rights to. This is a serious crime carrying serious legal consequences!

- Posting Illegal Content: Posting anything that is not legal in the United States.

- Posting Off-Topic: Posting something that does not belong in that newsgroup, as indicated by its charter or FAQ article.

- Crossposting: Posting the same article to more than three newsgroups is prohibited. The article posted must be on-topic for each group it is posted to.

- Harassment/Cyberstalking: Threatening or provoking confrontation with another party, causing fear for ones personal safety. Posting anyone's personal information such as phone numbers, addresses, social security numbers, etc. without that person's prior consent also falls under this category.

SYSTEM SECURITY

I will not attempt to bypass any security and/or access features of this site.

VIOLATIONS

If I use these services in violation of this agreement, I understand I may be in violation of local, federal and or civil laws. I agree to be responsible for all legal fees and loss of any income that I owe to the providers, owners, Corporate Officers, and/or creators of this site as a result of my activities. I understand that my membership will be canceled without notice or refund in such situations.
